2. Scope of service

ArtGraph provides programmatic access to a curated database of artists, artworks, exhibitions, and galleries via a REST API and an MCP (Model Context Protocol) server. The Service is offered on a tier-based subscription model (Free, Pro, Business).

The Service is intended for use by developers, researchers, businesses, and AI application builders who wish to integrate art-world data into their products and workflows.

3. Account registration

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your API key and login credentials.
• You must provide accurate and complete information during registration.
• You may not share your API key with third parties or allow others to use your account quota.
• You are responsible for all activity that occurs under your account.

4. Acceptable use

You agree not to:

• Use the Service in any way that violates applicable law or regulation.
• Attempt to reverse-engineer, scrape, or bulk-download the underlying database beyond the quota limits of your plan.
• Use the Service to build a competing art data product by re-distributing the raw data at scale.
• Attempt to circumvent rate limits, quota enforcement, or authentication mechanisms.
• Use the Service to transmit malicious code or interfere with the infrastructure.
• Misrepresent data retrieved via the Service as originally sourced or owned by you.

5. Quotas and rate limits

Each plan includes a monthly query quota. Queries in excess of your plan limit will be rejected until the quota resets. Quota resets occur monthly on your billing anniversary date.

We reserve the right to apply temporary rate limiting to protect service availability. Rate-limiting counters are stored in Redis and expire automatically within 60 seconds.

6. Payment and billing

• Paid plans are billed monthly in advance via Stripe. Prices are in euros (EUR) and include VAT where applicable.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel your subscription at any time through the billing portal in your dashboard. Access continues until the end of the current billing period.
• We do not offer refunds for partial billing periods, except where required by applicable Austrian consumer law (KSchG).
• We reserve the right to change pricing with at least 30 days' notice to registered users.

7. Intellectual property

The art data accessible through the Service has been collected from publicly available sources. ArtGraph does not claim copyright over underlying artwork images or biographical facts about artists. However, the compilation, structure, and delivery of the data — including the API, database schema, and software — are proprietary to Artsiom Kunitsyn.

You retain all rights to applications and products you build using data retrieved via the Service, provided your use complies with these Terms.

8. Availability and warranties

We aim for high availability but do not guarantee uninterrupted access to the Service. The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy of data.

We do not warrant that the art data is complete, accurate, or up to date. You are responsible for validating data retrieved from the Service before relying on it for commercial decisions.

9. Limitation of liability

To the maximum extent permitted by Austrian law, Artsiom Kunitsyn shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including loss of profits or data.

Our total aggregate liability to you shall not exceed the amount you paid for the Service in the three months preceding the event giving rise to the claim. For free-tier users, liability is limited to €100.

Nothing in these Terms limits liability for gross negligence, wilful misconduct, personal injury, or any other liability that cannot be excluded under mandatory Austrian law.

10. Termination

You may delete your account at any time from your dashboard. Upon deletion, all personal data is removed within 30 days in accordance with our Privacy Policy.

We may suspend or terminate your access if you breach these Terms, with immediate effect for serious violations (e.g. attempting to bypass quota or authentication). We will give reasonable notice for minor violations where practical.

11. Governing law and disputes

These Terms are governed by Austrian law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Vienna, Austria, unless mandatory consumer protection rules (KSchG) require otherwise.

If you are a consumer resident in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
